Terms of Service

1. Agreement to these terms

These Terms of Service (“Terms”) govern your access to and use of Recall, including our website, web application, AI-assisted card and deck features, file uploads, study tools, downloads, and related services (together, the “Service”).

By creating an account, accessing, or using Recall, you agree to these Terms. If you do not agree, do not use the Service.

If you use Recall on behalf of a school, organization, or other entity, you represent that you have authority to bind that entity to these Terms.

2. Eligibility and accounts

You must provide accurate account information and keep your login credentials confidential. You are responsible for activity that occurs under your account.

Notify us promptly if you believe your account has been compromised. We may suspend or terminate accounts that violate these Terms or that create risk for other users or the Service.

3. Acceptable use

You may use Recall only for lawful, educational, and personal study purposes consistent with these Terms. You agree that you will not:

• Use the Service for malicious activities — including cheating on tests or exams administered by educational institutions, or using decks/content to find, track, contact, or target people online for non-study purposes.
• Upload personal information about yourself beyond what is needed for your account, or upload other people’s personal information (names tied to private data, contact details, ID numbers, addresses, medical data, or similar).
• Abuse bugs, glitches, misconfigurations, or experimental features to obtain access beyond your plan (for example, unlocking Pro or Premium capabilities while on Basic).
• Force, inject, reverse engineer, or otherwise alter the app, client, APIs, or stored data to gain features, limits, or content you are not entitled to.
• Treat the Service as a messaging, social, or communication platform. Do not create spam decks filled with random text, solicitations, advertisements, or attempts to message other users.
• Create decks of gibberish, nonsensical strings, or other non-understandable content that adds no genuine study value.
• Use Recall to spread dangerous information, including restricted or illegal recipes, instructions for weapons or explosives, guidance for committing crimes, or other harmful how-to content.
• Harass, threaten, defraud, or exploit other people through public decks, shared links, profiles, or any other feature.
• Scrape, bulk-export, or automate access to the Service in a way that overloads systems or violates rate limits, except as expressly allowed by features we provide (such as normal downloads of your own decks).
• Interfere with security, authentication, billing, usage metering, or other users’ ability to study.

4. Subscriptions, billing, and cancellation

Recall may offer free and paid plans (such as Basic, Pro, and Premium). Plan features, limits, and prices are described on the Pricing page and may change over time.

You may cancel a paid subscription at any time. Cancellation stops future renewals, but payments already made are not refunded. Your paid access continues through the end of the then-current billing period (the subscription end date), after which your account may revert to a free or lower plan.

Taxes, currency conversion, and payment-processor fees may apply. Failed payments may result in downgrade, suspension, or loss of paid features until billing is resolved.

Promotional credits, trials, or test accounts (if offered) may have additional conditions and can be revoked if misused.

5. Downloads and branding

Where your plan allows downloads, exported decks or files may include a small indicator, logo, watermark, or attribution at the end (or elsewhere in the file).

You must not remove, crop out, obscure, or alter that indicator. Keeping the mark helps others recognize content that came from Recall and supports honest attribution.

6. Your content — cards, decks, and uploads

You retain ownership of the study content you create or upload (“Your Content”), including card fronts/backs, deck titles and descriptions, and source files you submit for conversion.

By using the Service, you grant Recall a limited license to host, process, display, transmit, and back up Your Content as needed to operate the Service for you (and, if you make a deck public, to display it to other users as you configured).

You represent that you have the rights needed to upload and use Your Content, and that it does not infringe others’ intellectual property, privacy, or publicity rights.

Public decks may be discoverable by other learners. Do not publish confidential school materials you are not allowed to share, or any content banned under Acceptable use.

7. AI card generation and file conversion

Pro and Premium features may use third-party AI providers to generate flashcards, refine text, grade ambiguous quiz answers, or convert uploaded study materials into cards.

AI output can be inaccurate, incomplete, biased, or inappropriate. You are responsible for reviewing generated cards before relying on them for studying, teaching, or assessment prep.

File uploads are processed to extract text and create cards. Do not upload malware, password dumps, or files containing prohibited personal or dangerous information.

Usage of AI prompts, tokens, uploads, and related meters is subject to your plan limits. Circumventing those meters violates these Terms.

We may log technical metadata and usage counts needed for billing, abuse prevention, and service quality. We do not claim ownership of the educational meaning of Your Content solely because AI helped format it into cards.

8. Privacy

We collect account details (such as email and display name), subscription and usage data, and content you store in Recall in order to provide the Service.

Public profile information and public decks may be visible to other signed-in users. Private decks remain accessible only as allowed by our access controls, subject to these Terms and applicable law.

We use industry-standard providers (for example, authentication, database, and AI vendors) that process data on our behalf. Do not submit sensitive personal data into card fields or uploads when it is not necessary for studying.

You can request account deletion through in-app settings where available. Some records may be retained for a limited time for security, legal, or billing requirements.

9. Recall intellectual property

The Recall name, logos, UI design, software, and documentation are owned by Recall or its licensors. These Terms do not transfer ownership of the Service to you.

You may not copy, modify, distribute, sell, or create derivative works of the Service except as allowed by features we expose (such as downloading your decks with required branding intact).

10. Enforcement

If you violate these Terms — including plan abuse, spam decks, cheating-related misuse, or removal of download branding — we may remove content, limit features, suspend or terminate your account, and cooperate with schools or authorities when legally required.

We may investigate suspected abuse, including unusual usage patterns that suggest unauthorized plan access.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, RECALL DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated cards will be correct for your curriculum or exams. Studying with Recall does not guarantee academic outcomes.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RECALL AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO RECALL FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE CLAIM AROSE (OR ZERO IF YOU USE ONLY A FREE PLAN).

Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent allowed.

13. Indemnity

You agree to defend and indemnify Recall against claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your misuse of the Service, or your violation of these Terms or applicable law.

14. Changes to the Service and Terms

We may update features, plans, and these Terms from time to time. Material changes may be communicated through the Service or by email when appropriate. Continued use after changes become effective constitutes acceptance.

We may modify or discontinue parts of the Service with reasonable notice when practicable.

15. Governing law and disputes

These Terms are governed by the laws applicable in the jurisdiction where Recall operates its primary business, without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply.

Before filing a formal dispute, you agree to contact us and attempt to resolve the issue informally. Nothing in these Terms limits rights you cannot waive under local law.

16. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.

These Terms, together with any plan descriptions and in-product notices, are the entire agreement between you and Recall regarding the Service.
